Allgemeine Geschäftsbedingungen für das Arberschutzhaus
der Fürstlich Hohenzollernschen ARBER-BERGBAHN e.K.

Section 1: House Rules
Please observe and comply with all general house rules.
Avoid making excessive noise. This also applies for the areas around the staircases, the guest rooms, the terrace and the guest house forecourt.
All our accommodation is non-smoking. In the event of non-compliance with these rules, the owner reserves the right to terminate the rental contract without any refund. Close all windows and doors when leaving the room. This includes the front door after 8pm.
We would also appreciate if you could turn off any lights and lower the heating when leaving a room.

Section 2 - Guest Registration Agreement
A guest registration agreement is concluded upon the booking and confirmation of the accommodation. The receipt of your booking via email is binding! You will receive an email confirmation.

Section 3 - Payment/Deposit/Final Payment
Once a booking confirmation has been sent, the guest must transfer the total amount due for accommodation and breakfast to the ARBER-BERGBAHN account. The customer has two weeks to complete the transfer after the contract conclusion. If this deadline is not met, the contract will be terminated in accordance with the applicable cancellation policy.

Section 4 - Cancellation and Contract Withdrawal
Cancellations must be made in writing. The guest/renter may cancel the booked accommodation. This is required in writing via email (arberschutzhaus@hohenzollern.com).
A general service charge of €5.00 will apply. In addition, the cancellation fees are as follows:
• for cancellations up to 8 weeks before the rental period 30% of the agreed rental cost
  (minimum €20.00 + service charge)
• for cancellations up to 14 days before the rental period 50% of the agreed rental cost
  (minimum €20,00 + service charge)
• for later cancellations 100% of the agreed rental cost
  (minimum €20.00 + service charge)
• for early departures the payment for booked time is forfeited.
• If the guest does not comply with these payment obligations within the required time, we reserve the right to call upon a collection agency of our choice to recover the debt. The guest will be liable for all costs incurred during this recovery process.

Section 5 - Arrival and Departure
Please be aware of the cable car opening times for arrivals and departures. Opening times during the summer season: 9:00am - 4:30pm

Luggage can be taken on the cable car free of charge, the appropriate season prices apply per person. Keys can be collected on site until 8pm with a tour of the accommodation. The owner will explain any rules to you. Accommodation can be used from 2pm on the day of arrival and the room must be vacated by 11am upon departure.

Section 6 - Cancellation by the Owner
If the accommodation booked by the guest is not made available, the owner is required to reimburse the amount already paid. The guest renounces any further claims from the contract.

Section 7 - Animals
Pets are not permitted. The cages for pets in the cellar can be used upon request. Pets are not allowed in the rooms.

Section 8 - Liability
The renter is liable for all costs resulting from damages caused during their stay. The owner cannot be held accountable for any short-term defects/outages in the furniture or technical systems (heating etc.). Price reductions are excluded. The same also applies for any force majeure. The renter is obliged to pay €150.00 for the loss of any keys, as the entire lock cylinder would have to be changed. The owner is entitled to enter the accommodation if required, for example, for any repairs necessary at short notice. The owner is not liable for the loss of any valuables. The use of room access, the rooms themselves, staircases and facilities etc. takes place at the user’s own risk.

Section 9 - Severability
Should any of the above clauses of the General Terms and Conditions become invalid, the remaining clauses will remain unaffected. The Parties will work to draft a new clause which reflects as closely as possible the intended regulation.

Section 10 - Court of Jurisdiction
In accordance with statutory provisions, Viechtach is the court of jurisdiction for all disputes arising from the rental agreement.
